Effective Date: 1/20/2008 Welcome to MedJobPulse.com™. We hope our website will be a useful tool to both visitors and Members. The following Terms of Use are designed to inform you of what should expect as a visitor or Member when using our website. This document is a binding Agreement ("Agreement") between you and MedJobPulse.com™ governing your use of the MedJobPulse.com™ website. Whether you are a visitor or a Member, y ou agree to be bound by and hereby become a party to all the terms of this Agreement. If you do not agree with the terms and conditions in this Agreement, you may not use this website. MedJobPulse.com™ reserves the right to amend this Agreement by posting the amended terms on this website. Any amended terms shall take effect upon the date of said posting. Each time you access or use MedJobPulse.com™ after any such amendment, you agree to be bound by the terms of the amended Agreement.
VISITORS AND MEMBERS
All are welcome as visitors to MedJobPulse.com™. However, membership with MedJobPulse.com™ is limited to (1) Jobseeking physicians or surgeons, (2) companies posting physician or surgeon job opportunities. When you become a member of MedJobPulse.com™ and each time you post (a) Job Seeking Physicians or surgeons posting CV, resume, or other related documents, (b) Employers with physician or surgeon job opportunities posting advertisements, job listings, or other related information, you attest that you are in fact a physician, surgeon, or employer with a physician or surgeon job opportunity. MedJobPulse.com™ reserves the right to terminate your Membership if we become aware that you do not meet the aforementioned requirements.
MEMBERSHIP
MedJobPulse.com™ membership is established by completing an on-line membership application. Information provided on your membership application is deemed confidential (See Privacy Statement). As a Member of MedJobPulse.com™ you will choose a username and password. Your username and password are used by you to access secured areas of MedJobPulse.com™. You are responsible for safeguarding your username and password. You agree not to disclose your username and/or password to any third party. You agree to take sole responsibility for any activities or actions under your username and/or password, whether or not you have authorized such activities or actions. It is your responsibility to notify MedJobPulse.com™ immediately of any unauthorized use of your username and/or password.
CONTENT SUBMISSION
When you, as a Member, submit a CV, resume, or related documents for jobseekers, or physician or surgeon job advertisement for employers, to the MedJobPulse.com™ website you certify that you are the author of and possess all rights to said submission. Once you post a submission on the MedJobPulse.com™ website it becomes the property of MedJobPulse.com™. Although you can select which personally identifiable information you wish to disclose, your name and any other information you specifically allow for listing are not deemed confidential communication. As such there is no duty of confidence regarding your CV, Resume, job postings or advertisements or related information on the part of MedJobPulse.com™, its agents, directors, officers or employees regarding said communication; only your identity is confidential if you specifically do not include it when you register. When posting a CV, Resume, job listing or advertisement on the MedJobPulse.com™ website you agree not to post any information that:
- is known by you to be false, inaccurate or misleading;
- violates any law, statute, ordinance or regulation
- is, or may reasonably be considered to be hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, partnership or corporation;
- is written for any compensation or consideration received from a third party;
- includes any information that references an individual’s addresses, email address, phone number, phone numbers or any other information that may reveal an individual’s identity ;
- to your knowledge contains any computer viruses, worms or other potentially damaging computer programs or files.
MedJobPulse.com™ reserves the right not to post to its website any submission that, in its sole discretion, does not adhere to the terms of this agreement. Additionally, MedJobPulse.com™ reserves the right to reproduce and distribute any submission using any medium without notice or compensation to you. If after an opinion or rating has been posted it is deemed to violate any term of this agreement, MedJobPulse.com™ reserves the right to remove said opinion without notice to you.
DOWNLOADS
As a Member of MedJobPulse.com™ you may print a copy of any content on our website, solely for personal and non-commercial purposes, subject to the restrictions set forth in this Agreement. All rights, title, and interest in any content appearing on MedJobPulse.com™ is and will remain the exclusive property of MDJR.com and its licensors. Except as expressly permitted in this Agreement, you may not reproduce, modify, distribute, sell, transfer, publicly display, transmit, or otherwise use information located on the MedJobPulse.com™ website.
WARRANTIES
The information contained on the MedJobPulse.com™ website has been presented with all due care. However, MedJobPulse.com™ makes no warranties, expressed or implied, regarding the accuracy or reliability of the content provided by it Members. Content posted on the MedJobPulse.com™ website is posted by Members who have elected to submit physician job related resumes, CVs, or advertisements.. As such, this content is for informational purposes only. Each CV, resume, and job listing should be used in conjunction with additional information gathered by you combined with your professional judgment. You should not rely on such information in situations where its inaccuracy would cause you to suffer any loss. MedJobPulse.com™ assumes no liability for inaccuracy or incompleteness in its search results, editorial content, resumes, CVs, physician or surgeon job advertisements, or other content. The content posted on this website do not reflect the views of MedJobPulse.com™, its employees, officers, directors, subsidiaries or any of its third party advertisers. MEDJOBPULSE.COM™. AND ITS THIRD PARTY ADVERTISERS SHALL NOT BE LIABLE TO YOU FOR ANY LOST PROFITS OR SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) EMERGING OUT OF OR IN CONNECTION WITH YOUR USE OF MEDJOBPULSE.COM™ SERVICES OR THIS AGREEMENT. We may cancel your account, or otherwise refuse service to you, at any time for any reason. MedJobPulse.com™ may choose to assume that you intended to terminate your account if you do not access it for more than 1 year.
THIRD PARTY ADVERTISORS
MedJobPulse.com™ provides third party links on our website. We believe the information, products and services accessed by entering these links will be of interest to visitors of our website and MedJobPulse.com™ Members. While MedJobPulse.com™ is paid by these providers to list their information on our website no agency relationship exists between MedJobPulse.com™ and its third party advertisers. MedJobPulse.com™ is not responsible for any information, products or services secured by visitors or Members from third party providers who advertise on our website. Additionally, MedJobPulse.com™ does not endorse any information, products or services offered by our paid advertisers. When you access any third party website from the MedJobPulse.com™ website you assume all risks. MedJobPulse.com™ disclaims any responsibility for, or liability related to, such information, products or services. Moreover, you may not use any method to collect email addresses belonging to MedJobPulse.com™ visitors or its Members.
ADDITIONAL TERMS
You agree to comply with the MedJobPulse.com™ Privacy Policy, which is incorporated into this Agreement, and with all laws and regulations applicable to your access and use of the MedJobPulse.com™ website and publishing of your content. This Agreement, all information incorporated by reference in this Agreement and any subsequent amendments to this Agreement may be assigned to a third party. Such assignment is at the sole discretion of the MedJobPulse.com™. Your obligations under this Agreement may not be assigned. If any provision of this Agreement is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions of the Agreement will remain in full force and effect, and the provision affected will be construed so as to be enforceable to the maximum extent permissible by law. Waiver of any provision of this Agreement or any incorporated documents may be accomplished only if in writing and signed by MedJobPulse.com™. We reserve the right to investigate and prosecute violations of this Agreement to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting users who violate the terms of this Agreement. You acknowledge that MedJobPulse.com™ reserves the right to monitor your access to the website to ensure full compliance with the terms of this Agreement. By choosing to use the MedJobPulse.com™ website, you agree to indemnify MedJobPulse.com™, its officers, agents, partners, and employees from any and all claims or damage, including reasonable attorney's fees, made by third parties due to, or arising out of Member reviews or ratings you choose to submit, post or transmit through the MedJobPulse.com™ website which violates this Agreement.
JURISDICTION
This Agreement is governed by Florida law. Any claims arising out of or relating to this agreement shall be settled by binding arbitration in Broward County, Florida in accordance with the American Arbitration Association’s commercial arbitration rules.
